These terms apply when you use bulklubricants.com.au and our customer portal (together, the Site). The Site is operated by Bulk Lubricants Australia ("we", "us"). Bulk Lubricants Australia is a trading name of Black Swan Farms Pty Ltd ACN 604 237 434 ABN 80 604 237 434. By using the Site you agree to these terms. If you buy from us, our Terms and Conditions of Sale also apply. If they conflict with these terms about a purchase, the Terms of Sale apply.

1. Using the Site

1.1 You may use the Site to find product information, request quotes, manage your account and (when available) buy online. You must not:

(a) use the Site unlawfully or in a way that could damage, disable or overload it;

(b) try to gain unauthorised access to the Site, our systems or other users' accounts;

(d) upload anything that is malicious, misleading, defamatory or infringes someone else's rights; or

(e) submit quote requests or orders in someone else's name without authority.

1.2 We may suspend or restrict access to the Site, or to an account, if we reasonably believe you've breached these terms, or to protect the Site or other users. Where practical, we'll tell you why.

2. Accounts and the customer portal

2.1 You can create an account to view quotes, orders and invoices. Keep your login details secure and tell us promptly if you think someone else has used your account.

2.2 If you use an account on behalf of a business, you confirm you're authorised to do so. Actions taken through the account are treated as the business's actions, unless the account has been used without authority and you've told us promptly.

2.3 You can ask us to close your account at any time. We may keep records as described in our Privacy Policy and as required by tax and other laws.

3. Product information, Lube Guide and technical content

3.1 Information is from TotalEnergies. Product descriptions, specifications, OEM approvals, technical data sheets (TDS) and safety data sheets (SDS) on the Site are provided by or sourced from TotalEnergies. Some documents open from TotalEnergies' servers. We take reasonable care to present them accurately, but TotalEnergies may update them at any time.

3.2 Check before use. Always check the current TDS, SDS and your equipment manufacturer's requirements before using a product. OEM approvals belong to TotalEnergies and the relevant OEM, and can change.

3.3 Lube Guide. The Lube Guide uses TotalEnergies' LubAdvisor tool to give general product recommendations based on the information entered. It is general information, not advice about your specific equipment or operating conditions. If you need confirmation, request a quote or contact us with details of your equipment.

3.4 Technical support requests may be passed to TotalEnergies' technical team (see our Privacy Policy).

3.5 Prices and availability. Prices shown "on quote" are confirmed on your quote. Online prices (when available) are shown at checkout. We try to keep information on the Site accurate, but errors can happen. A price or description error doesn't oblige us to sell at that price; see the Terms of Sale for how errors are handled.

4. Intellectual property

4.1 The Site's content, design and our logo belong to us or our licensors. TotalEnergies' names, logos, product names, images and documents are owned by TotalEnergies and used with permission as an authorised distributor. OEM names are used only to describe approvals and compatibility, and their owners don't endorse us. TotalEnergies' certifications (such as ISO 9001) and facilities belong to TotalEnergies.

4.2 You may view and print pages and documents for your own use in assessing and using our products, including sharing SDS and TDS with people who handle the products. You must not otherwise copy, modify, republish or commercially use Site content without permission, except as allowed by the Copyright Act 1968 (Cth).

5. Links and third-party services

5.1 The Site links to or uses third-party services, including TotalEnergies' sites and documents, our business and portal system, our payment provider (Stripe), our shipping platform (Starshipit) and carriers. Their own terms and privacy policies apply to your use of them. We're not responsible for third-party websites we don't control.

6. Quote requests and enquiries

6.1 Submitting a quote request doesn't create an order or an obligation on you or us. We aim to respond promptly but don't promise a response time. An order is formed only as set out in the Terms of Sale.

7. Our liability

7.1 Your consumer rights. Nothing in these terms excludes, restricts or modifies any right or remedy, including a consumer guarantee under the Australian Consumer Law, that cannot lawfully be excluded, restricted or modified.

7.2 Site availability. We aim to keep the Site available and secure, but we can't promise it will always be available, error-free or free of viruses. Use up-to-date security software.

7.3 Limits. Subject to clause 7.1, and to the extent the law allows, we're not liable for loss arising from your use of general information on the Site (such as Lube Guide results) without confirming it with us or checking the current manufacturer documentation, or from Site downtime. For services we provide through the Site, where the law allows, our liability for breach of a non-excludable guarantee is limited to supplying the services again or paying for them to be supplied again (ACL s64A(2)).

7.4 We aren't excluding liability for our negligence causing personal injury, or for fraud.

8. Your responsibility to us

8.1 If you breach these terms (for example, by uploading malicious code or scraping the Site), you're responsible for the reasonable loss and costs that breach causes us, reduced to the extent we contributed.

9. Privacy and cookies

Our Privacy Policy explains how we collect and handle personal information through the Site, including through cookies and analytics tools.

10. Changes

We may update these terms by publishing a new version with its date. Changes apply from that date to future use of the Site. If a change materially affects account holders, we'll tell them by email or portal notice.

11. Governing law

These terms are governed by the laws of Western Australia. Each of us submits to the non-exclusive jurisdiction of the courts of Western Australia. This doesn't limit any right you have to approach a consumer protection agency or tribunal in your state or territory.
